FINEX CAPITAL HOLDING SDN BHD (‘Finex & Co’) will make available the electronic copy of Will draft(s) (in PDF format) as an email attachment(s) to your email address as provided by you within seven (7) working days from the time you provide complete and accurate information. Upon confirmation of all the details in Will draft, we will deliver a printed copy (‘Product’) to your provided postal address.

The terms “we”, “us” and “our” refer to Finex Capital Holding Sdn. Bhd. whereas “you” and “your” shall refer to our agents / estate planners (also known as Finex Estate Planners or “FEPs”) or its customers.

Shipping

Shipping delay may happen especially during peak shopping or promotion periods. Rest assured we will try our best to process your orders. For West Malaysia customers, estimated delivery period would be seven (7) working days, whereas customers in East Malaysia can expect to receive orders within twenty-one (21) working days. We appreciate your patience and kind understanding during this period. If a product is not delivered within the estimated time frame, you may contact us for further assistance, including tracking details. Please note that Finex & Co is not responsible for delays caused by the courier service. However, we will assist you in tracking the shipment and liaise with the courier to resolve any issues.

Your Obligations

Upon receipt of the Will draft email from Finex & Co, you shall:

• Read the Will draft to confirm that all information therein is correct and reflects your wishes, including but not limited to, in respect of the beneficiaries, distribution of estate, appointment of executors and guardians.
• Notify Finex & Co of any errors to enable Finex & Co to provide you with a new Will draft.
• Notify Finex & Co by email to print out the finalized Will and have the Will to be delivered to you upon your confirmation that all the information in the Will draft is correct and accurate.
• Ensure the witnesses have no direct interest in the Will and are not named as beneficiaries or the spouse(s) of the beneficiaries under the Will.
• Keep the duly signed and witnessed original Will in a safe and secure place or have it kept with Finex & Co by subscribing to their Will custody service.

Your failure to comply with the above clause may render the Will invalid and or not enforceable and Finex & Co shall not be held liable for any loss and damage you suffer.

Upon receipt of the printed Will from Finex & Co, you shall:

• Read the Will draft to confirm that all information therein is correct and reflects your wishes, including but not limited to, in respect of the beneficiaries, distribution of estate, appointment of executors and guardians.
• Notify Finex & Co of any errors within seven (7) working days to enable Finex & Co to provide you a fresh will subject to charges payable by you.

Return & Exchange & Refund

No products can be returned.

You may at any time cancel or unsubscribe for the Service provided that such cancellation and un-subscription are done prior to drafting of the Will. Otherwise, any fees paid by you are not refundable. Finex & Co reserves the right to make refunds at its own absolute discretion.

Damaged or defective product

If you have received a damaged/defective product (eg, papers falling out of the file), please contact Finex & Co within seven (7) working days of receiving the product to request a replacement.

When Finex & Co receives an application from you for an exchange of damaged items, our team would require you to provide us with the visual evidence (e.g photo, video) of the Product(s) upon receipt. We do not accept exchanges for other reasons, such as changes in customer preference.

In the event of an unforeseen error arising from Finex & Co, we will either:

• Require you to send back the Product in person or via Postal Service (postage by customer) where we will use our reasonable efforts to perform a repair; or
• Send a fresh Will to your postal address, in which Finex & Co will bear all the shipping fees.
